The EB-3 Unskilled Worker Visa (also known as the “Other Workers” category) is a permanent U.S. immigration pathway that allows individuals with no advanced education, training, or work experience to obtain a green card and become a lawful permanent resident of the United States. Established under the Immigration and Nationality Act (INA) and amended in 1990, the program allocates 10,000 immigrant visas each year to unskilled workers worldwide.
With a critical shortage in the U.S. labor market — where even if every unemployed American were hired, over 4 million jobs would still remain open — the EB-3 program provides a valuable opportunity for motivated individuals to move to the U.S. and contribute to essential industries such as food processing, hospitality, manufacturing, construction, and health support services.

No education or work experience required

EB-3 Green Card Process: Step-by-Step Guide
Step 1: Prevailing Wage Determination (PWD)
The process begins when your U.S. employer, through our immigration attorneys, files a Prevailing Wage Determination (PWD) with the National Prevailing Wage Center (NPWC). This step sets the minimum wage the employer must pay based on the job position, duties, and work location, ensuring fair compensation according to U.S. Department of Labor standards.
Step 2: Labor Certification (PERM)
After receiving the prevailing wage approval, the employer must file a PERM application (Permanent Employment Certification) to prove that no qualified U.S. workers are willing or available to fill the position. This process involves recruitment efforts and can take several months, especially if the application is audited by the Department of Labor.
Step 3: I-140 Petition Filing
Once PERM is certified, the employer files Form I-140 (Immigrant Petition for Alien Worker) with U.S. Citizenship and Immigration Services (USCIS). This petition confirms the employer’s intent to hire you for the certified position. The I-140 can be filed with premium processing for a quicker decision (usually within 15 days) by paying an additional fee of $2,500.
Step 4: Green Card Application (Visa Processing or Adjustment of Status)
If you are outside the U.S.: You will apply for an immigrant visa through consular processing. This involves submitting Form DS-260, attending a visa interview at your local U.S. embassy or consulate, and receiving an EW3 immigrant visa.
If you are in the U.S. on a valid visa: You may file Form I-485 (Application to Register Permanent Residence or Adjust Status) along with your I-140 and Form I-765 (work permit). Most adjustment of status applicants are not required to attend an interview, making this a faster route in many cases.
Step 5: Arrival and Employment in the U.S
Once your green card is approved and you enter the United States, you must begin working for your sponsoring employer immediately. You are contractually required to work with the employer for at least one year. Failing to do so could result in the revocation of your green card.
Family Members of EB-3 Visa Holders
If your I-140 petition is approved, your spouse and unmarried children under the age of 21 may also apply for immigrant visas:
Spouse: Eligible for an EW4 visa
Children: Eligible for an EW5 visa
Once in the U.S., your family members can also live, study, and work legally as permanent residents. They will enjoy the same benefits as you, including the pathway to citizenship after five years.
